1. Introduction & Acceptance

By accessing or using MaxHSC ("we," "our," or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

2. Definitions

  • Account: Your registered user profile on the Service.
  • Beta: The free, limited-time testing period described in Section 8.
  • Content: All data, text, images, audio, video, code, or other materials you submit, upload, or receive via the Service.
  • Service: MaxHSC's AI-powered HSC response-marking platform, including all websites, applications, and APIs.
  • User: Any individual or entity accessing or using the Service.

3. Changes to Terms

We may modify these Terms at any time. Material changes will be notified by email to your registered address and via a banner on the Service. Continued use after notice constitutes acceptance of the updated Terms.

4. Description of Service

MaxHSC offers AI-driven evaluation and feedback on HSC student responses. Features include:

  • Band scoring aligned with official HSC criteria
  • Detailed written feedback and improvement suggestions
  • Support for Biology and Business Studies (additional subjects coming soon)

5. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with parental or guardian consent.

6. User Accounts & Registration

  • You agree to provide accurate, current, and complete information when registering.
  • You are responsible for safeguarding your password and account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • You may delete your account at any time via your settings or by contacting hello@maxhsc.com.

7. Subscription, Fees & Billing

(For future paid features)

  • We will clearly disclose fees, billing cycles, and renewal terms before you subscribe.
  • Payment methods accepted will be listed at checkout.
  • You may cancel your subscription at any time; cancellation becomes effective at the end of your current billing period.

8. Free Beta Terms

During our limited free Beta period:

  • Each free account receives 50 evaluations per calendar month.
  • Features, limits, and availability are subject to change without notice.
  • We may request feedback and usage data to improve the Service.

9. License to Use the Service & Content

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and download Content solely for your personal, non-commercial use.

10. User Content & License Grant

  • You retain all ownership rights in the Content you submit.
  • By submitting Content, you grant MaxHSC a worldwide, royalty-free license to process, analyze, and (if enrolled in training) use anonymized or aggregated versions of your submissions to improve our AI models.
  • You represent that you own or have rights to all Content you submit.

11. Acceptable Use Policy

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Submit Content that infringes third-party intellectual property rights
  • Attempt to reverse engineer, decompile, or hack the Service
  • Share your account credentials or permit unauthorized access
  • Overload, impair, or disrupt the Service or infrastructure

12. Intellectual Property Rights

  • All AI feedback, algorithms, software, and platform technology are the exclusive property of MaxHSC or its licensors.
  • Unauthorized use, reproduction, or distribution is prohibited.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind. We expressly disclaim all warranties, whether express or implied, including fitness for a particular purpose, accuracy, reliability, or non-infringement.

14. Limitation of Liability

To the fullest extent permitted by law, MaxHSC's aggregate liability for any claim arising from or relating to the Service is limited to the amount you paid us (if any) in the 12 months preceding the claim. We are not liable for indirect, incidental, special, punitive, or consequential damages.

15. Indemnification

You agree to indemnify, defend, and hold harmless MaxHSC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

16. Termination

  • We may suspend or terminate your account for violations of these Terms, at our sole discretion, with or without notice.
  • Upon termination, your right to use the Service immediately ceases.
